Health Warranty and Purchase Agreement

This contract is between the Owner/s of Blue Opal Labradoodles (Hereafter “Seller”) and ________________________(Hereafter “Buyer”)

1. The Seller guarantees that puppy
   is in good health;
   it has been examined by a licensed veterinarian;
   has been microchipped; and has had
   its first round of immunizations, before the         Buyer takes possession.
2. Seller agrees to provide the Buyer with the
    puppy’s pedigree and the
    number of the microchip that has been implanted in the puppy.
3The Buyer agrees to activate the complimentary 30-day trial of Puppy Medical Insurance provided by Blue Opal Labradoodles and Trupanion Pet Health Insurance.  Trupanion provides full-policy coverage, with immediate coverage, at no cost and no commitment from you to continue.  
-The Buyer agrees to  NOT to take the puppy to places where it would be at risk for infection, such as: pet stores, dog parks, kennels, grooming salons, etc. before being examined by their licensed veterinarian.
-The Buyer has three business days after taking possession of the puppy to take it to a licensed Veterinarian for a health examination. If the puppy is not taken to a licensed Veterinarian within three business days the Buyer waives the rights of this Healthy Warranty.
It is agreed that if the puppy is found to be in poor health at this initial examination:
The Buyer will immediately provide a written statement from a licensed Veterinarian clearly stating the defect or illness.
The Seller has the right to request a second opinion from a licensed Veterinarian.
If the puppy is found to be in poor health, the Buyer has the option of returning the puppy to the Seller, for a full refund; or keeping the puppy, and
The Seller will reimburse reasonable veterinary costs, related to treatment of any pre-existing illness up to the purchase price of the puppy.
TWO YEAR HEALTH WARRANTY
Blue Opal LLC provides a Warranty for the first two years of the puppy’s life to the Buyer against genetic disease that severely impacts the quality of the dog’s life.   The Seller will reimburse reasonable veterinary costs, related to treatment of genetically linked illness up to the purchase price of the puppy.   This warranty covers the following genetic diseases: Hip Dysplasia, Addison Disease, Cushing’s Disease, PRA, and Von Willabrand Disease.
– It does not cover viral diseases, allergies, dental procedures, improper bites, hernias, Giardia, Coccifosis or Parvo.   It also does not cover illness due to physical injury or the ingestion of foreign objects, chemicals.
Buyer’s Responsibilities
The Seller provides a Warranty for the first two years of the puppy’s life to the Buyer against genetic disease that severely impacts the quality of the dog’s life, provided that the Buyer has fulfilled the following requirements.
 Postpone strenuous, repetitive exercise until after their Australian Labradoodle is over one year of age. (jumping, excessive walking the stairs, jogging, etc.);
 Keep recommended veterinary appointments for their Australian Labradoodle;
 Keep all immunizations current according to the guidelines of the American Veterinary Medical Association; space vaccinations appropriately.
 Properly administer heartworm preventative medication. The Buyer is advised to
research the side-effects of Trifexis and Comfortis before using these products.
 House the dog indoors; and provide consistent human companionship and socialization with children, adult, and animals;
 Feed their Australian Labradoodle only a premium quality food and treats. Do not give foods / treats from areas with a history of hazardous products;
 Maintain their Australian Labradoodle at a healthy weight;
•If a severe or life threatening genetic disease is diagnosed by a veterinarian, the diagnosed must be communicated to Blue Opal LLC within three business days. The diagnoses must be confirmed by a second veterinarian that is chosen by Blue Opal LLC at their expense. The Buyer must supply any requested records, including diagnostic data, x-ray, laboratory testing, etc. to Blue Opal LLC within 10 days of request.
• If it is determined the puppy does have a genetic disorder that is identified within two years of purchase, the Buyer has the option of either a replacement puppy from the next available litter or receiving reimbursement of veterinary expenses related to the illness, up to the purchase price of the puppy. Your puppy need not be returned to us. If it becomes necessary to ship a replacement puppy, those fees are to be paid by the Buyer.
If the puppy is euthanized or in any way disposed of, without a second opinion from a Blue Opal LLC approved veterinarian, the Buyer waives all rights to a replacement puppy or financial payment as compensation. If the puppy dies of a suspected genetic disease by the age of 2 years, a licensed veterinarian acceptable to Blue Opal’s veterinarian must perform a necropsy. If the necropsy shows a genetic disease as the reason for death, Blue Opal LLC will provide another puppy to the Buyer or refund up to the purchase price. In the event of an indeterminable or inconclusive diagnosis this warranty is void. No warranties or guarantees, expressed or implied, are made under this contract except as stated. This warranty is non-transferable.
 The Buyer agrees to pay the Seller a  sum of ______________& MD Tax
 The Buyer has read and agrees with this warranty and the attached Spay/Neuter agreement (below).  
 The Buyer agrees to provide basic obedience training with their Australian Labradoodle puppy within the first year of owning their dog.
 The Buyer agrees to contact the Seller immediately if the Buyer determines they are unable to keep their Australian Labradoodle for any reason, The Buyer and Seller together will determine how the dog will be re-homed
 The Buyer agrees to never place the Australian Labradoodle in a shelter, pound or a similar facilities or research laboratory.
This agreement shall be governed by and construed in accordance with the laws in the state of Maryland.

ATTACHMENT
                          Blue Opal Labradoodles of Maryland Spay/ Neuter Contract
 
By purchasing a puppy from Blue Opal labradoodles LLC, you (Buyer) understand it has been sold as a pet and you are obligated under contract to:
____ spay or neuter this dog before it is eight months old or within six months of receipt of dog.
____You agree to send Blue Opal Labradoodles proof of the spay / neuter in the form of a certification from a licensed Veterinarian within 15 days of the procedure. This documentation needs to contain the dog’s microchip ID. Number.    You agree that you are to NEVER breed this dog, and that breeding rights are OWNED exclusively by the owners of this dog’s bitch and sire.
_____You agree that if you attempt to breed this dog: you will surrender ownership of the dog and pay a penalty of $15,000 to Blue Opal Labradoodles of Maryland (seller of the puppy). You understand the owner of the sire of the puppy may require additional damages.
If, within the agreed timeframe,
the owners of BLUE OPAL LABRADOODLES DO NOT RECEIVE PROOF of the spay/neuter of your pet
(Microchip ID #_________________ ) they will be forced to seek legal action.
_____You (the Buyer) by signing this contract also agree to pay any and all personal and legal expenses incurred by the Seller, Blue Opal Labradoodle in retrieving the dog and/or the penalty fees to Blue Opal and owner of the sire of your puppy’s litter.
